    You are also incapable of murdering a tree. Not because you can't end the tree's life, but because murder is defined as the unlawful killing of another human being.

    There is no distinction made between someone's sexual orientation in marriage. If marriage is defined as between two people of the opposite sex people then homosexuals are no less capable of marriage than a heterosexual person is. Rights are not the issue, they're entirely equal. Semantics are.

    Under the assumption that the union two humans of the same sex is marriage. To be clear I support homosexuals' right to be married, because I consider it a right, but what is being debated is what constitutes marriage.

    The definition of marriage, "is a social union or legal contract between people that creates kinship." People being the operative word here, so I return blocking two people of any sort to legally create that kingship is a restriction of rights.

    They can deal with it. On the gay marriage issue there is a homosexual couple in my town that emigrated form the U.S. and denounced citizenship solely because the federal government doesn't recognize gay marriage. I here this starting to get more common.

    I defer that marriage should not exist in modern, secular society. Rather it should be Domestic Partnerships/Civil Unions. Marriage should be bestowed by religious institutions as an "addition" to that.

    There for its not a right, or this is entirely biased. Also homosexual couples are not considered families for the most part, cause to be a family you must be a social union of two people living and married together.

    Also should we not deal in opportunities as well? Because there is an inequity when it comes to opportunity because we are denying two homosexual people the opportunity to get married to each other.

    I strongly believe that it s not the governments right to define, regulate, or even recognize personal relationships between people.

    Though i agree, are we not denying someone who wants to get married to Skyrim this as well?, so by doing so what is to say everything should be allowed in the realms of marriage. are we not denying the person an opportunity to marry Skyrim or am i just being stupid?

    As mentioned, America defines marriage differently. From the 1996 Defence of Marriage Act "the word 'marriage' means only a legal union between one man and one woman as husband and wife, and the word 'spouse' refers only to a person of the opposite sex who is a husband or a wife.".
    The applicable court cases are Loving v Virginia (defining Marriage as a civil right, and that includes the right to marry whom one chooses), and Goodridge v Department of Public Health (A Massachusetts case holding that a state ban on gay marriage would be unconstitutional by the Massachusetts constitution). I actually just wrote a paper on why US marriage law is inequitable, but as it stands gay marriages aren't recognized in any way shape or form by the federal government.

    That's not the federal definition of marriage in the US. You can't cross apply your standards here.

    Let's say I declare that all Americans have the right to a NeoCube should they so desire it. A NeoCube is defined as "a magnetic toy with item number NCBG, made by the NeoCube Corporation."

    Some people like Nanodots more. They think that they too have a right to a NeoCube, but would argue that a better definition for the NeoCube is "a magnetic toy composed of several small metal balls that can form various shapes." This definition includes the Nanodots as part of the NeoCube that every American has a right to.

    In reality, whether or not they like the way that NeoCube is defined, they still have a right to one. Such is the case with marriage in the US. Everyone has the right to be married, but the definition of marriage used by the state may not appeal equally to them.

    Yes, it also means that states that don't recognize gay marriage doesn't need to recognize a marriage license between a gay couple that came from a state that does recognize gay marriage. The more significant application of this, however is that you can't file federal income taxes, or claim dependents for the purposes of federal benefits.
