    I feel the need to step in here as I believe you were apart of this. First of all when he comes back once a week it's not really far to say he's been gone a month. Second, he was given a chance to plea his case. I know this because I was personally delegated the task to sitting down and chatting with Matt since I was the only member with a decent reputation pushing for the probation account (which was my suggestion, thnx). He was given a chance to explain his homophobic views and apologize to Matt and then it was put up to vote by mods, it failed.

    Oh and if you feel like coming out against me saying I switched sides or some shit let me put that to rest right now. I pled his case to Matt because I thought he deserved a chance, even after the repeat offenses, to explain his actions and then come back with a probation account to see if he truely was all sorry and shit. I went to Matt against my better judgment with Napoleon's promise he would let it drop after this. He didn't and in turn broke a promise to me.

    So he can fuck off for all I care.

    Plenty as in like 4? Practically everyone has insulted Che. Half the modship earned a ban from insulting Che. It's far from what should've been stacked up.

    One or two is again hardly even.

    So? I'm not saying he has a right to it I'm saying the current system doesn't provide that right, which is a bad thing.

    Not really. You don't allow people to attend the appeal and how can someone defend their actions without them being present? Especially since, in the case of Che, he was accused of a million things. No one could keep track of it but a select few mods. Che certainly didn't know.
    Again, that's why I'm not saying he should be unbanned. I'm saying Prohibition is the solution.

    We infracted other users whos comments merited infracting, just like che. We didn't infract che for every comment, and we don't infract everyone for every questionable bit of content. As always, if you ever feel someone has stepped over the line, report the post and we will review it.

    And that's not habeas corpus. That's a combination of other legal principles that loosely form part of the conception of the rule of law - another thing not mentioned in our site rules. When infracted we cite the section of the rules, and the objectionable content. We then let the user and the accuser present their case and then he rest of the staff debates on the issue. That's actually a further extension of the rights of the accused then provided by habeas corpus. Habeas corpus is the right of a prisoner to petition the government to determine whether his imprisonment was lawful - that's it. Kind of sounds like the appeals process ay? You know exactly what you're accused of, and why. You're given the option to explain yourself, and mediated by a third party observer. You guys are all smart enough here to be able to write a few paragraphs to back up an opinion, there is no need to draw out the appeals process any longer then it already is by letting the two parties comment on every one of our comments.

    While Che, might have been accused of many things, he was only disciplined on two very clear positions. Personal insults and hate crime, which we made very clear to him, via pm's and direct conversations between him and Stalin. Stalin told him what he needed to do to stay on the site, and he violated that trust. Again, if you're trying to say that Che failed to understand a one on one conversation with Stalin, which was predicated by numerous Pm's and thread's by the rest of the staff, you're really just insulting his intelligence.

    Yes yes I know Che did violate those things. Which is, again, why I can't say he deserves unbanning. But again, Prohibition is fine.

    You can't have a double standard like that. Che's insults must then be waved. Although I'm pretty sure you have no idea what you were talking about.

    I want him brought back under Prohibition. Meaning he would be barred from everything but the Gamings section and NKVD section. Actually maybe not even the NKVD section if Mayor doesn't want him.

    Who's to say that he won't start calling everybody a rat and passing out death threats? You're getting nowhere. This silly idea of yours that you still cling to will never be implemented and the fact that you still refuse to let go of it only shows how you are only an annoyance when it comes to suggesting alternative ways to punish people.

    I'm glad you believe justice should be delivered by popular vote.

    Che was reasonable on most issues. Sure you might not agree with it, but he agreed with most of you on most issues. He merely had extremities on a select few, such as Libya, North Korea, Jews, whatever.

    By cutting out the Coffee House, Off-Topic, etc. he has nothing to insight him to post his extreme views. He wont simply pop into the TF2 Tourny thread and start talking about the Libyan War. And if he does, he's on Prohibition. End him if he keeps acting up for some reason.

    In other words, all posts are a reaction to another post. If Che has no Libyan posts to react to, he has no reaction to give. Thus, normality.

    Actually Prohibition is now a widely known option, it is only the stubbernness of linear-thinkers like yourself that keep us from achieving further progress for the NKVD.

    Che was not reasonable on most issues. Since his return, he just told everybody that they deserved to die. If they presented evidence effectively disproving all of his ramblings he'd just say "biased" and run away. I could care less what his beliefs were, it was his antisemitism and his general hatred of the community that got him banned. He wasn't banned because of his opinions, rather his hate speech.

    I can see what you're trying to get at here and it is acceptable, but what if he isn't in the clan or doesn't even want to join it in the first place? Prohibition is as good as banning someone in this case. Plus, if you were put on this scheme of yours for hate speech like Che, the community has taken offense to it and probably hate the guy anyway. It's not like he can barge his way into participating. Again, this is as good as banning him.

    Okay, so I'm a stubborn linear-thinker. I've never participated in any NKVD activities, it doesn't interest me. I'm talking about the forum as a whole. The forum does not revolve around the clan, I could care less of it's progress.

    I wouldn't give someone as low as you the honor of receiving my reasons. Previously you were simply another mod, but after you openly attacked Che, a crime you deserved (temporary) banning for, any shred of respect I had for you became so many burning pieces of hatred.

    You deserve nothing from this forum. Chelsea and Toast deserve more respect than you.

    Yes he was. He was average on most of them. That's why he didn't talk on them much, he had nothing to add.
    Again, extreme issues. And how can you use his argumentative forms as a reason for his banning? You seem to be more frustrated with Che than concerned with the well-being of the NKVD and Forum.

    I can think Chelsea is wrong on practically everything and still play Wurm with her. It's not like I, or anyone, just breaks into a fit of rage whenever they hear the mention of someone they dislike politically.
    Actually he can. He needs only make an account on Shores of Hazeron to participate in the NKVD. It's not hard.

    He wished for the death of not just his rivals, but people who were fighting for him (me, and a few other members) and his friends (Soviet). He latter extended this personal attack to everyone on the forums. Please reread those sections of the Libya thread if you think his language was merely his debating style. And even if it was, Stalin has made it very clear he doesn't want that kind of language on the forums. Ethics aside, it's Stalin's image and forums he's trying to cultivate, not any of our ideas about what a forum should be.
