    If the NCLB Act was unconstitiutional, why was it not reviewed and struck down by the Supreme Court?

    From what I gather, it was an optional complience act and therefore it was not declared unconstitutional.

    This sums up how it is unconstitutional. As for the Supreme Court, I really don't have a answer.
    It is the main government making the states bend to the education system they want. Basically it frowns on state's rights.

    Even if the court was completely unbiased (which its not) people just make mistakes, or have their own motives.

    My point was that I did not hear of the NCLB being brought before them to decide on.
    If there was such sentiment amoung the people that the NCLB was unconstitutional, then it could be brought before the United States Supreme Court.
    No, they are not perfect, but in this case, it doesn't sound like they even had the chance to rule on the matter.
    Therefore, attacking them for not calling it unconstitutional is rather unfair.

    From what I understand in the provided link, the person is arguing that the NCLB is unconstitutional due to the fact that the Constitution of the United States of America does not say specifically that the government has the authority to regulate the educational system. That is a claim that I will have to check myself. And I insist that everyone else does as well, as well as check for precidents for both sides as we have lawyers for translating the law as we do priests for translating the Bible for a reason, you know.
    However, in the meantime, the argument that it is still constitutional is that the NCLB is optional, not mandatory, and thus functions more as a scholarship program than anything else.
    Should the optional clause be true, in that particular argument, it is still constitutional [to my knowledge]. It doesn't place a direct hand into the matters of states or local groups unless they conform to the prerequisites in pursuit of the funding that accompanies it. I this way, [all of this I noted above] the Act remains constitutional since it only requires the same proceedures that are required by any other group giving out a scholarship. That is to say, they set up requirements to aquire the funding and have every right to inspect to ensure that all of the requirements are followed.

    Yep tens of millions out of work, Poverty rates though the roof, several new wars potentially, It would be like Bush jr. if he was crazy and stupid, reeeeally entertaining.
