You can't claim a genre as your intellectual property, mostly because it can't be physically or digitally manifested outside of the products that spring up from it. If we went with your line of thinking, the first person to pioneer a genre would own the whole thing, which doesn't make any sense. Then we would never have more than one franchise to any genre, and that just wouldn't work. I don't support internet censorship, but not supporting copyright laws at all is a tell tale sign of a angsty teen who thinks he's standing up for the interwebz. Sorry, but in today's modern world, you can't just have a idea and then fuck over everyone with a similar idea. You have to jump through some legal hoops to protect your creations, then your fine. It's not particularly difficult, nor expensive. The world doesn't run on your silly universal code of ethics, people aren't forced to respect anything that isn't legally binding.

DOTA is a good game, but it's certainly not the best. There are plenty of game that are better. And there was certainly nothing that indicated I was a fanboy. As for you, you realized your argument was dumb, so all you can do is back out with a insult.
